PIECES OF A DREAM

UNDER COPYRIGHT LAWS: Unless there is an agreement to the contrary or the photograph or video is shot as part of your job, a copyright to a photograph generally belongs to the creator which in this context is myself ERSKINE FENTY.

As the copyright owner, I own the exclusive rights to display, copy, use, produce, distribute and perform my creation as I see fit and approve. As the owner of all of these photographs and words, I have a right to publicity, which allows ME to get paid for the commercial use of MY work, likeness or representation and all of my personal creations.

I AM shocked to find out that once I post on most SOCIAL MEDIA that although I still “own” the photograph, I HAVE unwittingly granted that SOCIAL MEDIA PLATFORM a license to use MY photographs in anyway they see fit for free and I grant them the right to let others use MY pictures as well! 

This means that not only can that SOCIAL MEDIA PLATFORM make money from MY photographs or video (otherwise, a copyright violation), but that SOCIAL MEDIA PLATFORM are making commercial gain by licensing these images, which contains MY photos or videos (otherwise, a violation of their “rights of publicity”).

It would seem that under most SOCIAL MEDIA PLATFORM'S current terms (which can change at anytime), by posting MY pictures and videos, I have granted that SOCIAL MEDIA PLATFORM “a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any [IP] content that I post on or in connection with Facebook (“IP License”). This IP License MAY end WHEN I delete MY IP content or MY account unless MY content has been shared with others, and they have not deleted it. 

I despise the fact that most SOCIAL MEDIA PLATFORMS can license MY content to others for free without obtaining any other approval from MYSELF! I AM aware that once MY photos or videos are shared on Facebook, it could be impossible to delete them from that SOCIAL MEDIA PLATFORM, even if I delete the content or cancel MY account (the content still remains on those SOCIAL MEDIA PLATFORM'S servers and they can keep backups)! 

So, although I may be able to withdraw MY consent to the use of photos on these SOCIAL MEDIA PLATFORMS, I WILL also keep in mind that if I share MY photos and videos with any SOCIAL MEDIA PLATFORM'S applications, AND THAT THOSE applications may have their own terms and conditions of how they use MY creation! 

In a nutshell, you as an individual who does not work for any of these SOCIAL MEDIA PLATFORMS, should not try and take the liberties by further abusing my copyrights in law just because I have not plastered the word COPYRIGHT all over the place. PLEASE PLAY FAIR.
